General Terms and Conditions of Wolf & Wolf GmbH for the purchase of tickets for the International Special Bikes Show SPEZI via the online ticket store

1. scope of application 

1.1 The following terms and conditions apply to contracts concluded for the sale of admission tickets by Wolf & Wolf GmbH (79787 Lauchringen DE) for the International Special Bikes Show SPEZI (hereinafter referred to as SPEZI) and the purchaser of admission tickets (hereinafter referred to as the customer). They apply exclusively to contracts concluded using the respective internet portal. 

1.2 Customers within the meaning of these terms and conditions are consumers or entrepreneurs. 

1.3 Deviating, conflicting or supplementary General Terms and Conditions shall not become part of the contract, even if known, unless their validity is expressly agreed to in writing.

1.4 Express reference is made to the SPEZI house rules, which apply to the entire SPEZI premises and to all visitors and are displayed there. Via the link https://spezialradmesse.squarespace.com/rechtliches and on the SPEZI website before the ordering process.

1.5 The tickets ordered via the ticket store operated by an external service provider for SPEZI are sold exclusively in the name and for the account of SPEZI for SPEZI 's own events.
 

2. conclusion of contract

2.1 SPEZI invites the customer in the ticket store to submit offers to purchase an admission ticket for the events listed there at the conditions stated there. 

The customer submits a binding offer by sending his order. The customer thereby agrees to be provided with an admission ticket electronically. The contract is concluded and the customer's offer accepted when the SPEZI sends an email confirming the order or, in any case, when the SPEZI initiates the collection of the ticket price. SPEZI uses external service providers to process the payment. The customer waives receipt of the acceptance. 

In the case of an offer to purchase a combination ticket that includes admission to the exhibition event as well as the right to use the respective transportation company, the transportation contract itself is concluded exclusively between the respective transportation company and the customer, despite acceptance of the offer by SPEZI.

2.2 The customer has fulfilled his performance obligation when the invoice amount has been credited to SPEZI 's account. At this time, SPEZI 's obligation to deliver to the customer and to the address specified by the customer in the order process is due. 

2.3 By submitting his offer, the customer also declares his consent to invoicing and dispatch by electronic means. There is no entitlement to invoicing in paper form. 

2.4 The Client's attention is drawn to the retention and archiving obligations of electronically received documents for entrepreneurs, in particular in accordance with the German Fiscal Code, the German Value Added Tax Act, the German Commercial Code, the principles of proper IT-based accounting systems (GoBS) and the principles of data access and verifiability of digital documents (GDPdU). According to GDPdU and § 14b UStG, the e-mail sent by SPEZI with the attached invoice is subject to retention and digital archiving. 

2.5 The customer warrants that all data provided by him during the ordering process is correct and that he is of legal age at the time of ordering. 

3. exclusion of liability/limitation of liability 

3.1 The liability of the SPEZI is excluded for losses caused by improper cooperation or inadequate technical equipment of the invoice recipient in connection with invoices transmitted to him electronically. Liability is also excluded for invoices not recognized by the tax office or input tax deductions not recognized, unless the SPEZI is responsible for this. 

3.2 The liability of SPEZI, its legal representatives and its vicarious agents is excluded in principle. 

3.3 The exclusion of liability does not apply in the event of gross negligence/willful intent on the part of SPEZI or gross negligence/willful intent on the part of its legal representatives or vicarious agents or in the event of culpable breach of a material contractual obligation by the aforementioned. Towards companies iSd. § However, SPEZI 's liability in such cases is limited to the foreseeable, contract-typical and direct average damage at the time of conclusion of the contract. 

3.4 The above limitations of liability do not apply to claims of the Customer arising from product liability. Furthermore, the limitations of liability do not apply to physical injury and damage to health or loss of life of the Customer caused by a culpable breach of duty by SPEZI, its legal representatives and its vicarious agents. 

4. binding purchase, non-existence of a right of withdrawal 

4.1 There is no right of return or refund for admission tickets, unless the event is canceled by SPEZI . In this case, the customer will be refunded the purchase price if he/she makes a corresponding request no later than two weeks after the originally planned start of the event. Cash refunds are excluded. 

4.2 For the sale of admission tickets, the customer (regardless of whether he is a consumer or an entrepreneur) has no right of withdrawal in accordance with § 312 g para. 2 no. 9 BGB (German Civil Code) pursuant to § 355 BGB.

5. data protection 

5.1 Information on data protection and data processing of customer data can be viewed on the SPEZI homepage, to which explicit reference is hereby made. 

5.2 In the respective ticket store of an event, consent to data processing for private visitors and trade visitors must be declared separately during the ordering process; in the corresponding order step, reference is made to the applicable information and provisions on the subject of data protection; the required documents can be accessed here. 

6. final provision 

6.1 The law of the Federal Republic of Germany shall apply. In the case of consumers who do not conclude the contract for professional or commercial purposes, this choice of law shall only apply insofar as the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his habitual residence. The provisions of the UN Convention on Contracts for the International Sale of Goods shall not apply. 

6.2 The place of performance is Lauchringen.

6.3 If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be the local or regional court of Waldshut-Tiengen, depending on the subject matter jurisdiction. The same shall apply if the customer does not have a general place of jurisdiction in Germany or if his place of residence or habitual abode is unknown at the time the action is filed. 

6.4 Should individual provisions of the contract with the customer, including these General Terms and Conditions, be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The wholly or partially invalid provision shall be replaced by a provision whose economic success comes as close as possible to that of the invalid provision.

For the administration of exhibitor data, bookings and communication processes for the SPEZI International Specialized Bicycle Fair, we use the ProFairs trade fair software from

web://contact GmbH, Christian-Messner-Straße 23, 56073 Koblenz.

Processing of personal data

The ProFairs system processes personal data required for the planning, organization and implementation of the trade fair. This includes in particular contact data, company information, booking and communication data as well as uploaded files.

The processing is carried out on the basis of Art. 6 para. 1 lit. b GDPR (fulfilment of contractual obligations) and Art. 6 para. 1 lit. f GDPR (legitimate interest in efficient trade fair organization).

Hosting and data security

The data is processed exclusively on servers in Germany:

  • Telehouse data center, Frankfurt am Main

  • Data centers of the service provider Hetzner Online GmbH in Nuremberg and Falkenstein

The servers are redundant and data backups are carried out regularly.

Access and access protection are regularly checked in accordance with documented technical and organizational measures (TOM).

Data ownership and access

All data recorded in ProFairs belongs to the trade fair organizer, who is responsible for it under data protection law.

The organizer has the option of independently backing up or deleting all data at any time via the ProFairs API.

If desired, external applications can be connected to read or synchronize data from the system.

Use of the ProFairs account

The following data protection principles apply when using the ProFairs account:

  • No cookies or storage technologies are used that are not technically necessary.

  • Matomo is used to analyze usage - exclusively in cookie-free mode, i.e. without the need for consent.

  • All scripts, fonts and resources are loaded directly from the ProFairs servers; the IP address is not transmitted to third parties.

Technically necessary cookies:

  • CFID and CFTOKEN: These cookies are used to maintain the session between server and client. They enable the system to recognize the user over several page views. The storage period is 30 years.

  • PROFAIRS_MESSEID: This cookie ensures that the user remains at the selected trade fair during the session. It is deleted at the end of the session.

  • CFAUTHORIZATION_hash: This cookie stores the logged-in status of a user so that it is not necessary to log in again during the session. It is also deleted at the end of the session.

Beyond this, no other cookies or storage technologies are used that are not technically necessary.

Order processing

There is a contract for order processing (AV contract) between the SPEZI international specialty bike fair and web://contact GmbH in accordance with Art. 28 GDPR.

In particular, it defines the technical and organizational measures for the protection of personal data. The contract can be viewed on request.

Storage period and deletion

The storage period of personal data is not limited by the system.

Deletion periods are based on the organizer's specifications.

Data can be deleted at any time via the administration interface ("Control") or the API.

Consent

By registering and using the exhibitor area, exhibitors agree to the processing of their data in accordance with these data protection regulations.

It is not possible to use the exhibitor area without consent.
